. Browsing and submitting a purchase order on the website imply acceptance of the Conditions and the Data Protection Policies adopted by the website and indicated therein.

2. These General Conditions of Sale apply to the sale of products exclusively with reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by:

3. Before accessing the products provided by the website, the user is required to read these General Conditions of Sale, which are deemed to be generally and unequivocally accepted at the time of purchase.

4. The user is invited to download and print a copy of the purchase order form and these General Conditions of Sale, the terms of which RTP Motorcycle reserves the right to modify unilaterally and without prior notice.

5. The website, and therefore access to the products provided and their purchase, is available in the following languages:

Art. 2 – SUBJECT

1. These General Conditions of Sale govern the offering, submission, and acceptance of purchase orders for products on RTP Motorcycle and do not, however, regulate the provision of services or the sale of products by parties other than the seller that may be present on the same website through links, banners, or other hypertext links.

2. Before submitting orders and purchasing products or services from parties other than the seller, users are advised to verify the applicable terms and conditions of sale.

Art. 3 – CONCLUSION OF THE CONTRACT

1. In order to conclude the purchase contract, the user must complete the electronic order form and submit it by following the relevant instructions.

2. The order form contains references to the General Conditions of Sale, images of each product and the relevant price, the available payment methods, the delivery methods for the purchased products and the related shipping and delivery costs, as well as references to the conditions for exercising the right of withdrawal, and the procedures and time limits for returning purchased products.

3. Before concluding the contract, the user will be asked to confirm that they have read the General Conditions of Sale, including the information notice on the right of withdrawal and the processing of personal data.

4. The contract is concluded when the seller receives the completed order form from the user, subject to verification of the accuracy of the data contained therein.

5. The user shall be obliged to pay the price once the online order submission procedure has been completed. This shall occur by clicking the “buy now” button at the end of the guided procedure.

6. Once the contract has been concluded, the seller shall take charge of the order for its fulfilment.

Art. 4 – REGISTERED USERS

1. When completing the registration procedures, the user undertakes to follow the instructions provided on the website and to supply their personal data in a correct and truthful manner.

2. The confirmation shall in any case release RTP Motorcycle from any liability regarding the data provided by the user. The user undertakes to promptly inform RTP Motorcycle of any changes to the data previously communicated, at any time.

3. In the event that the user provides inaccurate or incomplete data, or in the event of disputes raised by the interested parties regarding the payments made, RTP Motorcycle shall have the right not to activate or to suspend the service until such deficiencies have been remedied.

4. Upon the user’s first request to activate a profile, RTP Motorcycle shall assign the user a username and a password. The user acknowledges that such credentials constitute the system for validating access to the Services and the sole system suitable for identifying the user, and that all actions carried out through such access shall be attributed to the user and shall be binding upon them.

5. The user undertakes to keep their access credentials confidential, to store them with due care and diligence, and not to transfer them, even temporarily, to third parties.

Art. 5 – PRODUCT AVAILABILITY

1. Product availability refers to actual availability at the time the user places the order. Such availability shall in any case be considered purely indicative, as due to the simultaneous presence of multiple users on the website, products may be sold to other customers before the order is confirmed.

2. Even after the order confirmation email has been sent, cases of partial or total unavailability of the goods may occur. In such cases, the order shall be automatically amended by removing the unavailable product, and the user shall be promptly informed by email.

3. If the user requests the cancellation of the order, thereby terminating the contract, RTP Motorcycle shall refund the amount paid within 15 days from the date on which RTP Motorcycle became aware of the purchaser’s decision to terminate the contract.

Art. 6 – PRODUCTS OFFERED

Art. 7 – PAYMENT METHODS AND PRICES

1. The price of the products shall be the one indicated from time to time on the website, except in cases of obvious error.

2. In the event of an error, RTP Motorcycle shall inform the purchaser as soon as possible, allowing the order to be confirmed at the correct amount or cancelled. In any case, RTP Motorcycle shall not be obliged to supply the goods at the incorrectly indicated lower price.

3. The prices shown on the website include VAT and do not include shipping costs. Prices may be subject to change at any time. Such changes shall not apply to orders for which an order confirmation has already been sent.

4. Once the desired products have been selected, they will be added to the shopping cart. The user shall then follow the purchase instructions, entering or verifying the information required at each step of the process. Order details may be modified before payment.

5. Payment may be made using the following methods:

Credit Cards Mastercard, Maestro, Visa, American Express, Apple Pay e Google Pay (via Stripe), Paypal, Klarna e Bank Transfer.

Art. 8 – DELIVERY

1. RTP Motorcycle ships throughout the entire Italian territory, excluding the State of Vatican City and the Republic of San Marino..

2. RTP Motorcycle shall deliver exclusively to the user’s address provided at the time of purchase.

3. For deliveries within Italy, delivery is generally carried out within 2–4 working days or, if no specific delivery date is indicated, within the estimated timeframe shown at the time of selecting the delivery method and, in any case, no later than thirty days from the confirmation date.

4. For countries within the European Union, delivery shall take place within 3–5 working days and, in any case, no later than thirty days.

5. For non-EU territories, delivery shall generally take place within approximately 10–14 working days.

6. If delivery cannot be completed, the order shall be sent to the carrier’s depot. In such cases, a notice shall be provided specifying the location of the order and the procedures for arranging a new delivery.

7. If the user is unable to be present at the delivery location at the agreed time, they are requested to contact us again in order to arrange a new delivery date.

8. If delivery cannot take place for reasons not attributable to us within thirty days from the date on which the order is available for delivery, we shall assume that the user intends to terminate the contract.

9. As a consequence of termination, the amounts paid shall be refunded, including delivery costs, with the exclusion of any additional costs resulting from the choice of a delivery method other than the standard method offered, without undue delay and, in any case, within 10 days from the date of termination of the contract. Any transport costs arising from the termination of the contract may be additional and shall be borne by the purchaser.

10. Shipping costs shall be borne by the purchaser and are clearly indicated at the time the order is placed.

Art. 9 – TRANSFER OF RISK

1. The risks relating to the products shall pass to the purchaser from the moment of delivery. Ownership of the products shall be deemed to be transferred upon receipt of full payment of all amounts due in relation thereto, including shipping costs, or at the time of delivery, if this occurs at a later date.

Art. 10 – WARRANTY AND COMMERCIAL CONFORMITY

1. The seller shall be liable for any defect in the products offered on the website, including non-conformity of the items with the products ordered, in accordance with the provisions of Italian law.

2. If the purchaser has entered into the contract as a consumer, namely any natural person acting on the website for purposes unrelated to any entrepreneurial or professional activity carried out, this warranty shall be valid provided that the defect becomes apparent within 24 months from the date of delivery of the products; that the purchaser submits a formal complaint regarding the defects within a maximum of 2 months from the date on which the defect was identified; and that the online return form is correctly completed.

3. In the event of lack of conformity, the user who has entered into the contract as a consumer shall be entitled to have the conformity of the products restored free of charge, by means of repair or replacement, or to obtain an appropriate price reduction or the termination of the contract with respect to the disputed goods and the consequent refund of the price.

4. All return costs for defective products shall be borne by the seller.

Art. 11 – WITHDRAWAL

1. In accordance with the applicable legal provisions, the purchaser has the right to withdraw from the purchase without any penalty and without providing any reason, within 14 days pursuant to Art. 57 of Legislative Decree No. 206/2005, starting from the date of receipt of the products.

2. In the case of multiple purchases made by the purchaser with a single order and delivered separately, the 14-day period shall start from the date of receipt of the last product.

3. The user wishing to exercise the right of withdrawal may send an email, indicating the order number and the user’s name, to: info@rtpmotorcycle.com

4. The purchaser shall exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or, alternatively, by submitting the standard withdrawal form referred to in Annex I, Part B, of Legislative Decree No. 21/2014, which is not mandatory.

6. The goods must be returned intact, unused, without any signs of wear, in their original packaging, complete in all its parts and accompanied by the related fiscal documentation. Subject to verification of compliance with the above, the website shall refund the amount paid for the products subject to withdrawal within a maximum period of 14 days, including any shipping costs incurred by the user.

7. The costs incurred for returning the goods shall be borne by the user.

8. As provided for by Art. 56, paragraph 3, of Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014, the website may withhold the refund until the goods have been received or until the purchaser has provided proof of having returned the goods.

9. The right of withdrawal shall not apply if the services and products of RTP Motorcycle fall within the categories set out in Art. 59 of Legislative Decree No. 206/2005.

10. The website shall issue the refund using the same payment method chosen by the purchaser at the time of purchase. In the case of payment made by bank transfer, and if the user intends to exercise the right of withdrawal, the user must provide the bank details (IBAN, SWIFT, and BIC) necessary to process the refund.

Art. 12 – DATA PROCESSING

1. The purchaser’s data are processed in accordance with the applicable legislation on the protection of personal data, as specified in the dedicated section containing the information notice pursuant to Art. 13 of Regulation (EU) 2016/679 (Privacy Policy).

Art. 13 – SEVERABILITY CLAUSE

1. In the event that any provision of these General Conditions of Sale is deemed null or invalid for any reason, this shall not in any way affect the validity and enforceability of the remaining provisions contained in these General Conditions of Sale.

Art. 15 – APPLICABLE LAW AND JURISDICTION

1. These General Conditions of Sale shall be governed by and interpreted in accordance with Italian law, without prejudice to any mandatory overriding provisions of the country of the purchaser’s habitual residence. Consequently, the interpretation, performance, and termination of the General Conditions of Sale shall be subject exclusively to Italian law.

2. Any disputes arising from and/or relating to these General Conditions of Sale shall be subject to the exclusive jurisdiction of the Italian judicial authority. In particular, where the user qualifies as a Consumer, any disputes shall be resolved by the court of the user’s domicile or residence, in accordance with the applicable law.
